These Terms form a binding agreement between you (the "Customer," "you") and Bòkatedral, LLC ("Bòkatedral," "we," "us"). You must be at least 18 years old, or the age of majority where you live, and able to enter a binding contract. By using the site you confirm that the information you give us is true and that you will use Bòkatedral only for lawful, personal, non-resale purposes unless we agree otherwise in writing.

Bòkatedral operates an online marketplace (a "venue") that connects independent, vetted Haitian sellers with buyers. For products sold by these third-party sellers, Bòkatedral is not the manufacturer, producer, grower, importer, packer, distributor, or seller. Each such sale is a direct contract between you and the seller; Bòkatedral is not a party to it and acts only as the platform that makes the sale possible. Where an item is sold directly by Bòkatedral, it is identified as a Bòkatedral ("house") product; everything else is a seller's own product.

Bòkatedral sells and ships within the United States. Prices are in US dollars, and any applicable sales tax and shipping are shown at checkout. Placing an order authorizes your payment method — it does not immediately charge it. Every order is reviewed by our team, normally within 24 hours. If we confirm your order, your card is charged and the order ships; if we cannot, the authorization is released and you owe nothing. An order is accepted only when we confirm it, and we may decline or cancel any order at our discretion (for example, suspected fraud, out-of-stock items, pricing errors, or a shipping restriction).

Card details are entered on and processed by Stripe, a PCI-certified processor. Card numbers never touch our servers; we receive only confirmation that a payment was authorized, captured, or refunded.

Products offered by independent sellers are provided to you "as is". Bòkatedral does not manufacture, source, inspect, test, certify, endorse, or guarantee those products and makes no representation or warranty of any kind about their quality, safety, authenticity, origin, ingredients, freshness, condition, legality, or fitness for any purpose. The seller is solely responsible for the products they list and sell — including sourcing, quality, safety, labeling, packaging, handling, and accuracy of the description. Your remedies for any defect, harm, dissatisfaction, or misdescription of a seller's product are against that seller, not Bòkatedral. If something is wrong with an order, tell us at [email protected] and we will help you reach the seller and apply our buyer-protection process where it applies — but this does not make Bòkatedral the seller or guarantor of the goods.

Many Haitian products are food, beverages, cosmetics, or dietary supplements. Read the label before you consume or use any product — ingredients, allergens, directions, warnings, and expiration dates come from the seller or manufacturer, not Bòkatedral. If you have allergies, medical conditions, are pregnant or nursing, or take medication, consult a qualified health professional first.

Dietary supplements and similar products have not been evaluated by the U.S. Food and Drug Administration and are not intended to diagnose, treat, cure, or prevent any disease. Statements about such products are the seller's or manufacturer's, not medical advice from Bòkatedral. You purchase and consume these products at your own risk, and to the maximum extent permitted by law Bòkatedral is not responsible for any allergic reaction, illness, or adverse effect arising from them.

To the maximum extent permitted by law, the Bòkatedral site and all products and services offered through it are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory — including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free, or that any product will meet your expectations. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

You understand that Bòkatedral is a technology venue and that third-party products carry risks we do not control. You knowingly and voluntarily assume all risks associated with buying and using third-party products — especially food, beverages, cosmetics, and supplements — and you are responsible for reading labels and deciding whether a product is suitable and safe for you and your household.

To the maximum extent permitted by law, Bòkatedral and its owners, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the site or any product — including product defects, contamination, mislabeling, allergic reactions, injury, illness, counterfeit or infringing goods, or late, wrong, or failed delivery.

To the maximum extent permitted by law, Bòkatedral's total aggregate liability for any claim relating to the site or an order will not exceed the greater of (a) the amount you actually paid to Bòkatedral for the specific order giving rise to the claim, or (b) US $100. These limits apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You will defend, indemnify, and hold harmless Bòkatedral and its owners, officers, employees, and affiliates from and against any claims, damages, losses, liabilities, and costs (including reasonable attorneys' fees) arising out of or related to (a) your misuse of the site, (b) your breach of these Terms or of any law, (c) your violation of any third-party right, or (d) any content you submit.

Returns and refunds are handled as described in our Shipping & Returns policy — generally a 7-day return window after delivery, with refunds to your original payment method. Because we review orders before charging, a declined order is never charged. Some items (for example, perishable food, opened consumables, or personal-care goods) may not be returnable for health and safety reasons; the product page and our returns policy will say so.

You are responsible for the accuracy of the information on your account, for keeping your password confidential, and for all activity under your account. Create only one account for yourself, keep your details up to date, and tell us promptly at [email protected] if you suspect unauthorized use. We may suspend or close an account that violates these Terms or poses a risk to buyers, sellers, or the marketplace.

You agree not to:

• use the site for any unlawful, fraudulent, or harmful purpose;
• submit false, misleading, or someone else's payment or identity information;
• infringe anyone's intellectual-property, privacy, or other rights;
• scrape, copy, overload, probe, or interfere with the site or its security; or
• resell products bought here as a retailer without our written agreement.

The Bòkatedral name, logo, site design, text, and graphics are owned by Bòkatedral or its licensors and are protected by law; you receive only a limited, revocable, non-transferable license to use the site for shopping. Seller listing content belongs to the sellers. If you post a review, comment, photo, or other content, you confirm you have the right to do so and grant Bòkatedral a non-exclusive, royalty-free, worldwide license to host, display, and use it to operate and promote the marketplace. Content must be truthful and lawful; we may remove content or reviews at our discretion.

Our Privacy Policy explains what we collect, why, how we use and share it, and your choices and rights. By using Bòkatedral you acknowledge and consent to the data practices described there.

The site relies on and links to third parties — including independent sellers, Stripe (payments), and shipping carriers — and may link to other sites we do not control. Bòkatedral is not responsible for the acts, omissions, products, content, or policies of any third party, and your dealings with them are between you and them.

We may update these Terms from time to time. The "Last updated" date and version at the top show the current version, and material changes will be brought to your attention where reasonable. Your continued use of Bòkatedral after an update means you accept the revised Terms.

If a dispute is not resolved, you and Bòkatedral agree that any dispute arising out of or relating to these Terms or the site will be resolved by binding, individual arbitration, and not in a court, except that either party may bring an individual claim in small-claims court. You and Bòkatedral waive the right to a jury trial and to participate in any class, collective, or representative action. This section does not prevent either party from seeking injunctive relief for intellectual-property or unauthorized-use claims. Where binding arbitration or the class waiver is not enforceable, disputes will be resolved by the courts identified below.

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. To the extent a dispute is heard in court rather than arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.

If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it. You may not assign your rights under these Terms; we may assign ours to an affiliate or successor. These Terms, together with the Privacy Policy and any policy referenced here, are the entire agreement between you and Bòkatedral about the site. Sections on seller responsibility, disclaimers, limitation of liability, and indemnification survive the end of your use of Bòkatedral.
